841 号令第四条第三款:出口管制违规首次与个人出境资格挂钩

《国务院关于出境入境管理的规定》(国务院令第 841 号,以下简称“841 号令”)于 2026 年 7 月 22 日签署、7 月 31 日公布,自 2026 年 9 月 15 日起施行。司法部、公安部、国家移民管理局三部门负责人就 841 号令有关问题回答记者提问,将本次立法要解决的问题归纳为加强公民出境安全风险防范、规范外国人入境管理、规范出境入境中介服务。

《国务院关于出境入境管理的规定》(国务院令第 841 号,以下简称“841 号令”)于 2026 年 7 月 22 日签署、7 月 31 日公布,自 2026 年 9 月 15 日起施行。司法部、公安部、国家移民管理局三部门负责人就 841 号令有关问题回答记者提问,将本次立法要解决的问题归纳为加强公民出境安全风险防范、规范外国人入境管理、规范出境入境中介服务。

值得注意的是第四条第三款。该款规定,中国公民违反出口管制、技术进出口管理等规定,可能危害国家产业安全、技术安全的,国务院商务等有关主管部门可以决定不准其出境。《出境入境管理法》第十二条第(五)项自 2013 年起即授权国务院有关主管部门就可能危害国家安全和利益者决定不准出境,第(六)项另为法律、行政法规规定的其他情形留有接口;把出口管制、技术进出口管理领域的违规行为具体化为一项有构成要件的不准出境情形,在我国行政法规层面尚属首次。

这一规定的实务影响尤为值得关注。此前企业开展出口管制合规,审查对象是货物、技术资料和交易文件,违规的法律后果主要由企业承担,包括不予许可、罚款、列入管控名单。841 号令将后果延伸至经手人员的出境资格,且不以刑事程序的启动为前提。对技术密集型的出海企业而言,合规审查的范围需要从物和合同扩展到人。

本文以下就本款的适用对象与企业层面处罚的关系、企业容易发生误判的几处、施行日前应当完成的回溯排查,以及当事人于口岸受阻后的应对顺序,结合条文与相关规定逐一说明,并就每一处给出可以着手的具体做法。

一、本款的适用对象是具体人员,企业的技术负责人与工程师均可能在其射程之内

第四条第三款的措辞是“中国公民”,不是企业。这一点与《出境入境管理法》第十二条第(二)项不同,该项要求当事人已属被判处刑罚尚未执行完毕之人,或者已属刑事案件的被告人、犯罪嫌疑人;第四条第三款没有设定身份要件,只要求存在违反出口管制、技术进出口管理等规定的情形,并且可能危害国家产业安全、技术安全。至于哪些人可能被认定为违规行为的行为人,条文未作列举,就出口管制业务的实际分工推想,作出决策的管理人员、签批技术转移文件的负责人,以及实际实施技术交付的工程技术人员,都可能被涵盖在内。

还需注意,企业层面的行政处罚与个人层面的出境限制并行不悖。企业依《出口管制法》被处以罚款、被责令停业整顿乃至被吊销出口经营资格,并不当然消解主管部门对相关人员作出不准出境决定的可能。

据此,企业可以先做一件成本很低的事,把两份名单对照起来看。一份是近三年有过境外出差记录的员工,另一份是接触过限制出口技术、两用物项技术资料或者核心工艺参数的员工。两份名单重合的部分,就是本款项下需要优先评估的人员。评估的内容包括其历次出境的事由、所对接的境外主体,以及当时企业有无相应的出口许可或者技术出口批准。名单不必求全,先覆盖研发、工艺与售后技术支持这几个岗位群,通常即可覆盖大部分风险敞口。对其中确有敞口而又需要频繁出境的人员,宜在企业内部单独标注,后续的出行安排一并纳入合规审核。

二、未发生实物出口不等于不在适用范围,派人提供技术服务同样可能构成技术出口

《出口管制法》第二条第二款规定,管制物项包括物项相关的技术资料等数据;同条第三款界定出口管制时列出两项并列行为,一是从中华人民共和国境内向境外转移管制物项,二是中华人民共和国公民、法人和非法人组织向外国组织和个人提供管制物项。后一项在文义上并不以跨境为要件,人在境内把受控技术交给外国机构,同样在这部法律的管辖之内。

《技术进出口管理条例》(2001 年国务院令第 331 号公布,2020 年国务院令第 732 号修订)第二条把技术秘密转让和技术服务明文列为技术转移的方式。一项从未申请专利的专有技术,通过派人到境外提供技术服务的方式交付给境外主体,可以构成技术出口;如果属于限制出口技术,依该条例第三十一条应当向国务院外经贸主管部门提出申请。

实践中,部分企业采取过“设备出不去就派人出去,图纸不能出口就让工程师到现场口头指导”的变通做法。2026 年 7 月 1 日施行的《国务院关于对外投资的规定》(国务院令第 837 号)第十三条已经明文禁止以跨境派遣技术人员、组织人员赴其他国家或者地区工作、跨境提供技术指导、安排人员跨境培训等方式,向其他国家或者地区转移国家禁止出口的货物、技术、服务及相关数据,或者未经许可转移国家限制出口的同类内容;841 号令第四条第三款则为这类行为配上了作用于个人的后果。因此,以“本公司没有出口过任何实物”作为不适用本款的依据并不成立,需要查核的是受控技术有没有实际交付给境外主体,以及交付采用了什么方式。

这类安排的痕迹通常不在合同标题,而在条款细节。回头审查既往的技术服务、售后支持、联合开发类合同时,可以重点看以下几处:交付物条款是否为空,或者仅笼统写为“提供技术服务”;有无约定人员派驻的期限、人数与驻场地点;服务内容中是否包含现场培训、操作指导、参数调试、故障排除一类的义务;对价的计算方式是按人天计还是按技术成果计。名义为服务而实质包含技术传授的,应当单独列出,逐份核对当时有无办理技术出口手续,以及所涉技术在行为发生时是否已被列入限制出口目录。

三、未收到处罚决定不等于事项了结,本款并不要求以生效处罚为前提

第四条第三款的构成有两项,一是违反出口管制、技术进出口管理等规定,二是可能危害国家产业安全、技术安全。后一项写的是“可能危害”,属于风险判断,不以已经造成危害为要件。前一项的表述是“违反……规定”,条文没有言明是否须以生效的行政处罚决定或者刑事裁判为前提。我们倾向于认为不需要。第四条第一款以受过行政拘留处罚为前提,第二款以经核实的境外违法犯罪行为为前提,第三款独无此类前提,从体系上看应属有意;该款的规范目的又在于风险的即时阻断,若须待处罚或者裁判生效方可启动,其防范功能将大打折扣。这属于文义与体系推论,配套规定出台前不宜视为定论。

若采这一理解,曾被主管部门约谈、被要求限期整改、被出具过责令改正通知,而最终未进入处罚程序的那些记录,仍然可能构成不准出境决定的基础。企业以“当时没有被罚”推断事项已经了结,在本款之下并不稳妥。

据此,企业宜把既往与出口管制、技术进出口有关的监管往来文书归集成册,包括约谈记录与谈话笔录、责令限期改正通知、现场检查记录、企业提交的整改报告及主管部门的回复。这类文书通常分散在报关、法务、生产、外贸等不同部门,经手人离职后尤其容易散失,而它们恰是主管部门判断“是否存在违反”时最直接的材料。归集之后逐份确认整改是否已经实际完成、当时认定的问题在现行业务中是否仍然存在。需要说明的是,主管部门对约谈、责令改正一类事项通常不会另行出具了结文书,实务中不必去追讨这样一份结论,可行的替代是留存整改报告的报送凭证与签收记录,以及此后检查未再提出同一问题的材料;确有必要时,在具体的出境安排之前就该事项向主管部门书面咨询并留存回复。

与此相关的是监管往来在企业内部的流转。刑事程序中的边控通常伴随立案、传唤、采取强制措施等可以感知的前兆,行业主管部门基于合规检查作出的决定则不一定有前兆。企业宜作出内部规定,凡收到主管部门的检查通知、约谈通知、责令改正通知,经办部门应当在收到当日报法务或者合规岗备案,不得由单一部门自行处理完结。

四、告知可依例外免除,期间又无法定上限,被限制者难以坐待其自动解除

841 号令第六条规定,决定机关应当及时通知移民管理机构执行,并向当事人书面告知不准出境的事实、理由、依据和救济途径;有可能影响国家安全、刑事案件侦查等情形的,可以不告知当事人。告知是原则,不告知是例外。需要注意此处的一处用语差异。第四条第三款的适用前提是“可能危害国家产业安全、技术安全”,第六条例外用的是“国家安全”。若认为前者属于后者的范畴,适用该款的情形就比较容易落进不告知的例外;若二者被区别对待,告知仍然是常态。条文对此未予明言,第六条但书还以“等情形”兜底,实际掌握到什么程度,有待执行口径显现。实践中不少人是在边检口岸被拦下时才知道自己不能出境,坊间所称的“隐形边控”,指的正是当事人感知上的这段空白。

期间方面的缺口更为直接。第四条第一款对因骗取出境入境证件、非法出境入境受到行政拘留处罚的人,规定自处罚执行完毕之日起 6 个月至 3 年以内不准出境;第二款对在境外从事违法犯罪活动、危害国家安全和利益的人,规定自回国之日起 6 个月至 3 年以内不准出境;第三款没有规定任何期间。这一空白可以理解为有意留白,也可以理解为留待配套规定补足,条文本身没有提供取舍的线索。但眼下的状态是确定的,三款之中只有第三款没有法定上限,何时解除取决于决定机关的判断,目前也没有看到定期复查或者依申请审查的安排。我们推测,这可能是配套规定会优先处理的内容之一。

在这样的制度安排之下,把“没有接到通知”当作可以出境的依据,把“到期自动解除”当作处置方案,都不稳妥。对前述已被标注为有风险敞口的人员,可行的做法是把出境合规核实前移,在重要出行的行程确定之后、出票与签证预约之前先行核实。核实渠道包括拨打 12367 移民管理服务热线,或者通过“移民局 12367”客户端、微信与支付宝小程序的在线服务,查询本人证件与出入境记录状态。需要说明的是,不准出境决定本身能否经由上述渠道确认,各地答复口径并不一致,因此重大出行还宜同时就该人员向可能的决定机关书面咨询并留存回执,或者由律师出函询问。企业层面则宜将这一核实动作嵌入商务出行审批流程,由法务或者合规岗出具意见后再行订票;涉及重大商务安排的,还应当准备替代方案,例如改由不涉敏感技术的人员前往,或者以线上方式完成,避免整个项目节点押在某一名人员能否成行上。

五、施行日前应当完成一次回溯排查,难点在于人员跨境活动难以从文件中辨识

第四条第三款约束的是“违反出口管制、技术进出口管理等规定”这一行为,而这类行为可能发生在 9 月 15 日之前。新规是否以及如何适用于施行日前的行为,有待配套规定或者执法口径明确;但从风险防控的角度,先把既往情况摸清楚仍属必要。企业当下要做的不是等待新规施行,而是回溯既往。

物项与数据方面,需要查核企业是否曾经向境外转移、或者向外国组织和个人提供过可能属于两用物项、限制出口技术的内容。范围应当按《出口管制法》第二条第二款算到“物项相关的技术资料等数据”,不能只看有形货物;也应当按《技术进出口管理条例》第二条算上未申请专利的技术秘密。

人员跨境活动方面,需要查核过去以技术交流、售后服务、短期培训、联合开发等名义安排的人员出境,其中是否实际发生了受控技术的转移。这一项是全部排查工作中最难做实的,原因在于此类安排在合同文本上往往不留痕迹,仅凭文件审阅无从辨识,须访谈经手人员,以实际发生的行为而不是文件表述为准。访谈的对象不宜限于出境者本人,还应当包括当时的项目负责人与技术对接人;各方陈述对不上的,以现场记录、往来邮件、境外主体出具的确认函件等书面材料为准。

排查的同时可以把台账建起来,逐次记录出境人员及其岗位、目的国家或者地区、境外接洽主体、所涉技术内容及其是否列入管制清单、出境事由与对应的合同、有无相应的许可或者批准文件、随行携带的资料与设备。台账自本次排查起向前追溯,能追多久追多久,此后按次新增。这份台账在自查时用于发现缺口,日后若需向主管部门说明,也是最省事的材料。

如果排查中发现属于限制出口技术、而当初没有依《技术进出口管理条例》第三十一条提出申请,处置方式需要区分两种情形。安排仍在履行之中的,宜立即暂停相关的人员派驻与技术交付,补办出口申请之后再行推进。技术转移已经完成的,现行制度并没有事后补办许可的程序,此时应当做的是评估违法与被处罚的风险,特别是该项技术在行为发生时是否已经列入限制出口目录,并准备一份说明材料,把行为发生的时间、技术的具体内容、接收方的身份与用途、当时的目录状态梳理清楚,必要时主动与主管部门沟通,不宜拖延搁置。

六、在口岸受阻后,首要工作是固定决定机关与依据,而非径行提出复议申请

救济路径本身是清楚的,但有一处常见误解需要澄清。《出境入境管理法》第六十四条虽然规定行政复议决定为最终决定,该条针对的是对外国人的继续盘问、拘留审查、限制活动范围、遣送出境,以及对其他境外人员的遣送出境;中国公民被决定不准出境不在这一条的射程之内,仍然走《行政复议法》《行政诉讼法》的一般路径,对国务院部门所作决定不服的向该部门申请复议,行政诉讼由中级人民法院管辖。

真正的障碍不在于找不到机关,而在于当事人是否知道决定的存在和内容。依第六条例外未获告知的,复议和诉讼都无从启动,救济的可用性因此取决于告知。

因此,当事人在口岸被拦下又没有拿到书面文书时,首要的工作不是撰写复议申请,而是先固定决定由哪个机关作出、依据是什么。841 号令第六条第二款规定,移民管理机构执行不准出境决定时,应当按照决定机关通知的内容告知当事人;当场援引这一款要求告知决定机关与依据,比笼统地要求出具文书更有依据,也更可能得到回应。同时应当记录受阻的口岸、时间、通道与经办人员。离开口岸之后,再向移民管理机构以及可能的决定机关分别提出查询,必要时申请政府信息公开。涉及国家安全的事项,信息公开申请有可能被答复不予公开,但申请本身即是固定“何时知道”的书面痕迹。复议与诉讼的期限自当事人知道或者应当知道决定之日起算,相关申请宜尽早发出并保留回执。查询始终无果的,还有一条路径可以考虑,即以边检机构的执行行为为对象申请行政复议或者提起行政诉讼,由被申请人、被告就执行所依据的决定举证,从而使决定机关与依据显性化。

对企业而言,841 号令第四条第三款带来的变化是具体的。出口管制的合规评估此前以物项与交易为对象,此后还需要以人员为对象。9 月 15 日之前可以先着手的,是把出境人员名单、既往技术服务类合同、历年监管往来文书归集起来,据此判断本企业有无需要补正的许可缺口,并把出境前的合规核实嵌进现有的出行审批流程。

常见问题

问:第四条第三款与通常所称的“边控”,是否属于同一性质的措施?

李睿律师:不属于。实务中所称边控,主要是《出境入境管理法》第十二条第(二)项因刑事程序而生的不准出境,以及第(三)项有未了结的民事案件、人民法院决定不准出境的情形,作出决定的机关同时是案件的处理机关,决定嵌在一个当事人通常已经知道的程序之中。第四条第三款由国务院商务等有关主管部门以行业合规状况为前提作出,不以刑事立案为条件,也不依附于任何在办案件,是另一条独立的路径。

问:企业未曾出口任何设备,仅派工程师赴境外提供技术支持,是否可能适用这一款?

李睿律师:存在这种可能。《技术进出口管理条例》第二条把技术秘密转让和技术服务列为技术转移的方式,未申请专利的专有技术并不因此免于规制,如果属于限制出口技术,依该条例第三十一条应当提出申请。另需注意《出口管制法》与该条例的射程并不完全重合,前者第二条第三款所称出口管制涵盖“向外国组织和个人提供管制物项”,文义上不以跨境为要件;后者以跨境转移为要件。一项行为落在哪一部法之下,需要分别判断。审查的重点是合同的实际履行内容,而不是合同名称。

问:被决定不准出境后,能否申请行政复议或者提起行政诉讼?

李睿律师:可以。《出境入境管理法》第六十四条关于复议终局的规定,针对的是对外国人的继续盘问、拘留审查、限制活动范围、遣送出境,以及对其他境外人员的遣送出境,中国公民被决定不准出境不在其射程之内,仍走《行政复议法》《行政诉讼法》的一般路径,对国务院部门所作决定不服的向该部门申请复议,行政诉讼由中级人民法院管辖。但 841 号令第六条允许在有可能影响国家安全、刑事案件侦查等情形下不告知当事人,当事人如果不知道决定的存在和内容,复议和诉讼都无从启动,所以实务中首要的工作往往是先把决定机关和决定依据固定下来,再谈救济。


《国务院关于出境入境管理的规定》自 2026 年 9 月 15 日起施行。本文就条文所作分析不构成针对特定事项的法律意见,具体适用须结合个案事实与后续配套规定。

Export Control Violations Can Now Bar Individuals from Leaving China

The Provisions of the State Council on Exit and Entry Administration (State Council Order No. 841) were signed on 22 July 2026, published on 31 July 2026, and take effect on 15 September 2026. At a press briefing, officials of the Ministry of Justice, the Ministry of Public Security and the National Immigration Administration described the legislation as addressing three matters: exit safety risk prevention for Chinese citizens, entry administration for foreign nationals, and regulation of exit and entry intermediary services.

The Provisions of the State Council on Exit and Entry Administration (State Council Order No. 841) were signed on 22 July 2026, published on 31 July 2026, and take effect on 15 September 2026. At a press briefing, officials of the Ministry of Justice, the Ministry of Public Security and the National Immigration Administration described the legislation as addressing three matters: exit safety risk prevention for Chinese citizens, entry administration for foreign nationals, and regulation of exit and entry intermediary services.

Article 4(3) has attracted comparatively little attention:

Where a Chinese citizen violates provisions on export control or on the administration of technology import and export, and may endanger national industrial security or technological security, the competent commerce department or other competent departments under the State Council may decide to bar that citizen from leaving the country.

Fifty-six characters. Their significance is not simply that one more ground for an exit ban has been added under Article 12 of the Exit and Entry Administration Law. Until now, the consequences of export control violations attached to goods, technology and transactions, and were borne by the enterprise: denial of licences, fines, confiscation of unlawful gains, and in serious cases revocation of export operating qualifications. Where an individual's ability to leave the country was at stake, criminal proceedings were required. Under Article 4(3), a sectoral regulator may act directly on a specific individual's ability to leave, without any criminal process.

1. The provision applies to individuals, and technical managers and engineers may fall within its reach

The text refers to "a Chinese citizen", not to an enterprise, and it does not require that the person already be a criminal defendant or suspect. Managers who take the decision, officers who sign off on technology transfer documents, and the engineers who actually deliver the technology may all be covered. A fine imposed on the company, or even revocation of its export operating qualifications, does not in itself remove the possibility of an exit ban against the individuals involved.

A low-cost first step is to compare two lists: employees with overseas travel records in the past three years, and employees with access to restricted-export technology, dual-use item technical data, or core process parameters. The overlap is the population to assess first. Covering R&D, process engineering and after-sales technical support will normally capture most of the exposure.

2. The absence of physical exports does not place a company outside the provision

Article 2(2) of the Export Control Law provides that controlled items include technical data related to those items. Article 2(3) defines export control as covering two parallel acts: transferring controlled items from within China to outside China, and Chinese citizens, legal persons and unincorporated organisations providing controlled items to foreign organisations or individuals. On its terms, the second act does not require any crossing of the border: a person inside China who hands controlled technology to a foreign institution falls within the statute.

Article 2 of the Regulations on the Administration of Technology Import and Export (promulgated by State Council Order No. 331 of 2001, current text as revised by State Council Order No. 732 of 2020) expressly lists the assignment of trade secrets and the provision of technical services as means of technology transfer. Unpatented proprietary know-how delivered to an overseas entity through personnel providing technical services may therefore constitute a technology export; if the technology is subject to export restrictions, an application must be filed with the competent foreign trade and economic cooperation department under Article 31, which reviews it jointly with the science and technology administration department and decides within thirty working days under Article 32.

In practice some enterprises have relied on workarounds along the lines of "if the equipment cannot go out, send the people; if the drawings cannot be exported, have the engineer give instructions on site". Article 13 of the Provisions of the State Council on Outbound Investment (State Council Order No. 837, effective 1 July 2026) now expressly prohibits transferring prohibited or unlicensed restricted goods, technology, services and related data by means of cross-border secondment of technical personnel, organising personnel to work abroad, providing cross-border technical guidance, or arranging cross-border training.

When reviewing historical technical service, after-sales support and joint development contracts, four points repay attention: whether the deliverables clause is empty or merely recites "provision of technical services"; whether the term, headcount and site of personnel secondment are specified; whether the scope includes on-site training, operating instruction, parameter commissioning or fault rectification; and whether consideration is calculated per person-day or by technical outcome.

3. The absence of a penalty decision does not mean the matter is closed

Article 4(3) requires only a "violation of provisions". It does not require a final administrative penalty decision or a criminal judgment. By contrast, Article 4(1) presupposes an administrative detention penalty already imposed, and Article 4(2) presupposes overseas conduct verified through diplomatic missions; the third paragraph alone contains no such precondition. On this reading, records of past regulatory interviews, orders to rectify within a time limit, and inspection findings that never proceeded to a penalty may still form the factual basis for a decision.

Enterprises are therefore well advised to compile their historical regulatory correspondence on export control and technology import and export: interview records, rectification orders, on-site inspection records, rectification reports and the authority's replies. Such documents are typically dispersed across customs affairs, legal, production and foreign trade functions, and are easily lost once the responsible individuals leave. Regulators do not generally issue a separate "closure" document, and there is little point pursuing one; retaining proof of submission, acknowledgements of receipt, and evidence that the same issue was not raised in later inspections will serve.

4. Notification may be dispensed with, and no maximum duration is prescribed

Article 6 makes written notification of the facts, reasons, basis and available remedies the rule, subject to an exception where national security or a criminal investigation may be affected. Article 4(1) and 4(2) each prescribe a period of six months to three years; Article 4(3) prescribes no period at all, and no mechanism for periodic review or review upon application is apparent.

It follows that treating "I have received no notice" as evidence that one may travel, or "it will lapse in due course" as a plan of action, is unsound. For individuals with identified exposure, verification should be brought forward: once travel is settled and before tickets are purchased or visa appointments made, the individual's document and travel-record status can be checked through the 12367 immigration administration service line or the associated app and mini-programs. Whether the existence of an exit ban itself can be confirmed through those channels varies in practice, so for significant travel a written enquiry to the likely deciding authority, with the reply retained, remains advisable. At the enterprise level, this verification step is best embedded in the business travel approval process.

5. Conduct occurring before 15 September 2026 may also be reached

What Article 4(3) addresses is conduct, and such conduct may have occurred before 15 September 2026. How the new provision applies to pre-effective conduct remains to be clarified, but establishing the historical position is worthwhile in any event. The scope of review must extend to "technical data related to controlled items", not merely tangible goods, and to unpatented trade secrets under Article 2 of the Technology Import and Export Regulations.

Cross-border personnel activity is the hardest element to establish, because it typically leaves no trace in the contract documents; interviews with the individuals involved are required, and a register of cross-border technology and personnel should be built in parallel. Where restricted-export technology was transferred without the application required by Article 31, arrangements still being performed should be suspended and the application filed before proceeding; where the transfer is complete, there is no retrospective licensing procedure under the current framework, and the appropriate course is to assess penalty exposure and prepare an explanatory record.

6. If stopped at the border, first establish which authority decided and on what basis

Article 64 of the Exit and Entry Administration Law, under which an administrative reconsideration decision is final, applies to foreign nationals and other persons from outside the mainland; a Chinese citizen subject to an exit ban falls outside it and retains the ordinary avenues under the Administrative Reconsideration Law and the Administrative Litigation Law. The real obstacle is not identifying the authority but knowing that a decision exists.

At the border, Article 6(2) of Order No. 841 may be invoked: the immigration authority is required, when enforcing an exit ban, to inform the person concerned in accordance with the content notified by the deciding authority. The port, time, channel and officers involved should be recorded. After leaving the port, enquiries may be addressed separately to the immigration authority and to the likely deciding authority, with a government information disclosure request where necessary. Time limits for reconsideration and litigation run from the date the person knew or should have known of the decision, so these enquiries themselves create a written record of when knowledge arose.

Frequently asked questions

Is Article 4(3) the same kind of measure as what practitioners call a "border control"?

Li Rui: No. Border control in practice refers mainly to exit bans arising from criminal proceedings under Article 12(2), and restrictions decided by a court where civil proceedings are unresolved under Article 12(3); in both, the deciding authority is also the authority handling the case. Article 4(3) is an independent administrative decision taken by the competent commerce department or other competent departments on the basis of a person's sectoral compliance record, without any criminal case being opened.

Our company has never exported equipment and only sends engineers to provide technical support. Can the provision still apply?

Li Rui: It can. What matters is the substance of contractual performance, not the contract title. Note also that the Export Control Law and the Technology Import and Export Regulations do not have identical reach: the former covers "providing controlled items to foreign organisations or individuals", which on its terms does not require a border crossing, whereas the latter requires cross-border transfer.

Once an exit ban has been decided, is reconsideration or litigation available?

Li Rui: Yes, through the ordinary channels. But Article 6 permits non-notification where national security or a criminal investigation may be affected. A person unaware of the existence and content of the decision cannot commence either proceeding, which is why the first task in practice is to establish the deciding authority and the basis of the decision.
